Prices are subject to change based on demand.

I have the right to reject any order for any reason.

Accepted currency is USD, paid through Paypal or Artistree’s payment services.

If any additional charges are necessary, commission cost will be discussed and agreed upon before the commission is accepted.

Payment can either be paid in full upfront, or split into two payments which would be made at time of order, and after initial sketch approval. Split payment is not an option in commissions in which there is no sketch approval stage.

Do not send me any payment before I have accepted the commission and have requested the payment via invoice.

I work best with a clear visual, full-body, colored reference for most characters, and need you to specify any specific details such as expressions or poses you want me to pay attention to in your commission. If nothing is specified, you'll get whatever I can come up with!

Time to completion can range from 1 week to 3 months, depending on factors such as health, complexity of the commission, and other work queued. If you're making a request that is time-sensitive, please let me know at the time of ordering so that I can determine if it's viable.

Depending on the work, Work-In-Progress (WIP) shots are available. For example, I do not offer WIPs for sketches or chibis. However, for more in-depth pieces I do give sketch WIPs for approval before moving on to lineart and coloring.

Upon completion, you will receive a full-resolution digital image file. If requested, a more web-friendly size can be created as well. Please be aware that my digital art commissions are not a physical product!

Please be sure to save all files upon delivery. I clean out my folders from time to time and may not be able to provide a copy at a future date.

Disclaimer: I may (and likely will) do or post personal art between commissions to help prevent myself from getting burned out. If you would be uncomfortable because of this, then please refrain from commissioning me. I won't tolerate rudeness or impatience in regards to this.

You get 3 rounds of revisions on the commissioned piece included in the price, throughout the process of the commission as WIPs are sent for approval.

If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.

If your reference is unclear to start with, late-stage changes will come at an extra charge unless a misunderstanding on my side was made.

I reserve the right to cancel and refund the order at any time for any reason.

I retain all copyrights over the commissioned artwork.

I will NOT claim the intellectual property (IP) of the commissioned artwork (your characters are still yours, etc.)

I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.

I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.

You may upload the commissioned artwork on any website and social channels for personal (non-commercial) use, such as profile pictures, avatars, backgrounds, decorations, etc.

You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, making prints for selling, etc.)

You MAY make small edits to works you have commissioned or received directly from me, such as minor color shifts, a missing detail, or cropping to fit as an avatar or banner.

You MAY "add-on" to my work. For example, if I draw line-art you may color it, or if I draw a sketch, you can finalize it.

If you alter or add-on to a commissioned piece in any way, the original piece MUST also be viewable and it MUST be clearly stated that the artwork has been edited. Please note, even extensive alterations require credit if my artwork is used.

You MAY be allowed to sell the artwork if it is a part of an Adoptable. Please discuss this with me (the artist) prior to paying for the artwork though.

You retain the rights to the intellectual property (IP).

You may NOT use the commissioned artwork for commercial purposes.

You may NOT use my artwork to promote hate, harassment, etc.

Reproducing/using the copyrighted artwork commercially - defined as making money off it in any way not excluded from these terms.

Claiming the artwork as your own

Do NOT buy from me if you only wish to scalp or turn profit from the designs.

Stealing and redistributing any design I have created that you don't own/have the rights over them will result in blacklisting.

Do NOT add extra restrictions to the usage of designs when trading, selling, etc. to a new owner.

Do NOT claim credit for the original design and art. Give credit when credit is due. You may credit my Toyhou.se account, Spottedheart, if hosting my designs there. Otherwise, crediting my deviantART account, Spottednova, is preferred.

You MAY resell, trade, or gift your adoptable at any time under your ownership.

You MAY use, post, and alter the purchased design for personal use. For example, uploading to social media, gallery sites, character hosting sites, or personal websites is permitted. I retain the rights to the artwork I have created, but otherwise the design itself is yours after purchase.

You MAY use the design in and my artwork for profile pictures, avatars, backgrounds, decorations, wallpapers, or other private contexts such as personal gifts.

You MAY edit the design. This includes changing species, gender, biography and/or story; You also can make "alternate forms." If traded, ensure the new owner is aware of all versions of the design if they are not traded together.

Do NOT maliciously omit credit or claim to be the sole creator of the design.

Do NOT use the original art of the design for commercial use. Only new artwork created (with consent from the artist) may be used by the owner of the design for commercial usage.

You MAY publish virtual works that feature the design, such as webcomics, games, music albums, and written works, with written acknowledgement of the design’s origins.

You MAY publish virtual works into physical works (such as a webcomic volume eventually being printed), IF credit for the design is given. Please reach out to me in this case!

You MAY use the design to promote content the owner has created.

You may NOT mass produce and sell physical merchandise that features the design’s original artwork. This is not limited to but includes selling clothing, accessories, keychains, toys, stickers, prints, posters, etc.

I do not offer refunds, or accept returns, for completed commission works or adoptable designs. Please be 100% certain before purchasing!

The buyer is not allowed a refund once I have started working on the commission.

If for any reason I am unable to start your commission you will receive a full refund.

If you cancel your order before I start it, you can get a full refund.

The kill fee for canceling the commission after work has begun is 50% of the commission's price. The client then receives the work as is.

If the buyer wishes to cancel the commission after the work has started, the buyer CAN be issued a refund but agrees to pay the kill fee.

If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.

If you request a Paypal chargeback at any point you will lose all aforementioned rights to the commissioned piece. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you.

Furthermore, unsolicited charge-backs will result in cancellation of any pending commissions, revoking of any involved adoptable designs, and a ban from my content. I retain the right to recycle and reuse created content involved in the charge-back for other purposes. You will be blacklisted from commissioning me again.

Any designs I've made that a blacklisted user owns before blacklisting will not be revoked. However, they are not permitted to purchase or receive any further designs or commissions from me. The design will follow all general trade rules while under the blacklisted party's ownership. However, commercial usage is forbidden.

Harassment, block evading, hate speech, and explicit content are automatic ways to be blacklisted. I reserve the right to refuse service to anyone for any reason.
